The chief of the Law and Justice’s election campaign has lost a lawsuit against the Open Dialogue Foundation. Joachim Brudziński will be obliged to publish an apology and pay damages for his tweet in which he labelled the Foundation’s members as the “Euro- Kazakh crooks”.
At this point, it should be recalled that the case concerned a comment published on 22 April 2019. Mr Brudziński posted that “defenders of Euro-Kazakh crooks” are “useful idiots” (writing his comment in Cyrillic script). He added that December’s “miraculous resurrection of Mr. D. and the Rossmann candles were funded with laundered dirty money”
The Open Dialogue Foundation, which conjectured that it was the recipient of this tweet, has decided to fight for its rights in court. So far, they are doing so successfully.
According to Press.pl, the court had no doubts to whom the above-quoted comment posted by Joachim Brudzinski referred.
“The court found that there had been an unquestionable infringement of personal rights, particularly in the context of unauthorised and serious allegations concerning money laundering by the Foundation,” said Martin Mycielski, Head of Communications at ODF, in his interview with Presserwis.
The court did not treat the Law and Justice’s chief of the election campaign with forbearance. The politician has been obliged to publish an apology note (pinned for 60 days) and pay PLN 30 thousand in compensation for the benefit of ODF and its management i.e. Lyudmyla Kozlovska and Bartosz Kramek.
However, the judgment is not yet final and may be challenged by the parties. Bartosz Kramek believes that the leading Law and Justice politician will exercise his right to bring an appeal to the second instance court.
“I have no doubts that Joachim Brudziński is going to appeal against this judgment. In my opinion, the financial penalty should also be more acute. Perhaps, in such a case, many people would think twice before they post a comment on social media. That would be much more educational,” said Kramek in his interview with Press.pl
