Maciej Wąsik disagrees with the judgement passed in the civil lawsuit brought by the Open Dialogue Foundation. The politician intends to file a cassation appeal. “When standing before a court, a person expects justice but finds Iustitia,” Wąsik commented on X.
On Friday, 23 February, Maciej Wąsik lost a civil lawsuit against the Open Dialogue Foundation, which is headed by Bartosz Kramek and his wife Lyudmyla Kozlovska.
What is the content of the judgement?
The Court of Appeal in Warsaw has ruled that Wąsik violated the Foundation’s personal rights and must publish an apology for the words he uttered in 2018. The apology is to be published on TVP Info, Telewizja Republika and Gazeta Polska Codziennie.
In addition, the Law and Justice (PiS) MP is to pay damages of PLN 10,000 each, plus interest, to Bartosz Kramek, Lyudmyla Kozlovska and the Open Dialogue Foundation.
This is a judgement handed down in the court of second instance, which means that it is legally binding. Under such circumstances, Wąsik can still file a cassation appeal to the Supreme Court.
What was the subject of the dispute between the Foundation and Wąsik?
Let us recall that the lawsuit concerned the politician’s statements in which he accused Kramek and Kozlovska’s Foundation of having ties with Russia, money laundering and hybrid activities. Kramek himself was accused of publicly calling for bloodshed.
The latter statement referred to Kramek’s social media post, which was entitled “Let the State Come to a Stop: Let’s Shut Down the Government!”. It proposed repeating in Poland the experience of the Ukrainian Maidan, which resulted in the overthrow of Viktor Yanukovych.
“He called for a coup, called for non-payment of taxes, considered bloodshed,” Wąsik commented in an interview with TVP Info.
Wąsik intends to file a cassation appeal
In an interview with ‘Interia’, Wąsik stated that he disagrees with the judgement and intends to take advantage of the previously mentioned extraordinary appeal.
“I am not ‘convicted’, the judgement was handed down in civil and defamation proceedings. I do not agree with it and, when I get the reasoning, I will file a cassation appeal to the Supreme Court. I have an appointment with an attorney in this case,” commented Wąsik.
Shortly afterwards, he added on X (formerly Twitter), “When standing before a court, a person expects justice but finds Iustitia”. Let us clarify that he is referring to the association of judges, which is known for its highly critical attitude towards the former United Right government.
