An enforcement bailiff ordered the seizure of the bank account of Maciej Wąsik, a member of the European Parliament from the Law and Justice Party (PiS). In this way, the final court decision was enforced, obliging Wąsik to pay PLN 30,000 as compensation for the violation of the personal rights of the Open Dialogue Foundation and its leadership – Lyudmyla Kozlovska and Bartosz Kramek.
The court’s judgement came as part of a lawsuit filed by Kozlovska, Kramek and the Open Dialogue Foundation against Wąsik for violating their personal rights. Wąsik, a former deputy Minister of Internal Affairs and Administration in the Law and Justice (PiS) government had publicly criticised the Foundation’s activities in 2018–19, accusing it of having ties with Russia, hybrid activities and money laundering.
The court upheld the judgement of the first instance, which obliged Wąsik to publish an apology for disseminating “hurtful and untrue information” and to pay compensation – PLN 10,000 each to Kramek, Kozlovska and the Foundation – a total of PLN 30,000.
Wąsik has neither apologised to the activists nor paid the adjudicated amount. The Foundation’s attorney, lawyer Dawid Biernat, has applied to the enforcement bailiff to initiate and carry out debt enforcement proceedings against the politician.
The amount seized from Wąsik’s bank account is more than PLN 50 000, of which 30 000 is the value of the debt, i.e. compensation, more than 11 000 is interest, more than 7 600 is legal costs, 900 is the cost of representation in enforcement proceedings and under 5 000 is the cost of enforcement.
The Open Dialogue Foundation and its management have brought a total of around 20 lawsuits against politicians and journalists for attacks on the Foundation during the PiS government. In the ongoing proceedings, the activists are demanding almost PLN 1.7 million.
The Foundation’s lawsuit against Maciej Wąsik is the first to go to enforcement proceedings.
