The Open Dialogue Foundation (ODF) announced that the enforcement bailiff had seized almost PLN 28,000 from the account of PiS MEP Maciej Wąsik. However, the amount seized is much higher due to interest and other costs. This is the result of the politician losing a lawsuit for infringement of personal rights.
Bartosz Kramek, ODF’s Chair of the Supervisory Board, announced the receipt of a bank transfer in the amount of 27,600 PLN. This comes from the bank account of Maciej Wąsik, a member of the European Parliament for the Law and Justice party, against whom an enforcement procedure was initiated following a lawsuit filed by the Foundation for violation of personal rights.
Maciej Wąsik lost the lawsuit. The enforcement bailiff collected the money
The case dates back to 2018–2019, when Maciej Wąsik, then Deputy Minister of Internal Affairs and Administration, publicly accused ODF and its founders, Bartosz Kramek and Lyudmyla Kozlovska, of having ties with Russia and of engaging in hybrid activities and money laundering. The Foundation, known for criticising the then PiS government, decided to take legal action.
In February of this year, the Court of Appeal upheld the first-instance court’s ruling, finding the Foundation’s claims as justified. According to the judgement, Maciej Wąsik was obliged to publish an apology within 14 days of the judgement becoming final.
The apology was to be published in several media outlets, including TVP Info, wPolsce.pl TV on YouTube and the website of Telewizja Republika. In addition, the politician was to pay compensation of a total of PLN 30,000 PLN – PLN 10,000 each to Bartosz Kramek, Lyudmyla Kozlovska and the Foundation.
Will Maciej Wąsik be forced to apologise to ODF?
As Maciej Wąsik did not comply with the judgement, on 18 June the Foundation’s attorney, lawyer Dawid Biernat, applied to initiate enforcement proceedings. The enforcement was handled by court bailiff Aleksandra Rudzka-Natanek, working at the District Court for Warsaw-Żoliborz. Over PLN 50,000 was withdrawn from the politician’s bank account, of which PLN 30,000 was awarded as compensation, over PLN 11,000 was interest, and the remaining amount covered the legal and enforcement fees, and the representation in the enforcement proceedings.
The Open Dialogue Foundation intends to go further than enforcing the compensation. Bartosz Kramek has announced that the next step will be to pursue the execution of the remaining part of the judgement, i.e. the publication of an apology in the media listed by the court. The Foundation’s attorney has already prepared a motion to the court demanding that Maciej Wąsik publish the apology within three days of the judgement becoming final, under penalty of a fine of PLN 5,000 for each day of delay.
