On 7 December 2017, the court dismissed the motion, personally signed by Witold Waszczykowski, for appointment of a compulsory administrator for the Open Dialogue Foundation. Still, his successor, Minister Jacek Czaputowicz is following in the footsteps of his predecessor.
On 29 December 2017, the ODF responded to a letter from Andrzej Jasionowski, the General Director of the Foreign Service of the Ministry of Foreign Affairs, who – in the last days of the office of his the then principal, Minister Waszczykowski – called on the Foundation to remove Bartosz Kramek’s famous publication dated 21 July 2017. In the text, Bartosz Kramek suggested that extensive civil disobedience actions should be undertaken in the face of an attack on the independence of the judiciary in Poland. Director Jasionowski called on the Foundation – this time in a correct manner, without confusing the addressees – to remove the publication, which ODF had made available on its websites in the summer; Jasionowski claimed that the publication was illegal. The Foundation refused to do so, requesting, at the same time, information as to which provisions of the law – in the opinion of the Ministry of Foreign Affairs – have been violated by the Management Board (which, under the Act on Foundations, could create grounds for such a demand).
Another letter – with the argumentation / justification of the ministry’s position, signed by the Director of the General Office, Magdalena Bogdziewicz, arrived on 11 January 2018. The ODF replied to it on 24 January 2018. Once again, the Foundation drew attention to the fact that Bartosz Kramek has never been a member of the Management Board of the Open Dialogue Foundation, and he published his text in his own name, while the Foundation published its own, separate statement at that time and explained the matter many times afterwards. The claim that Kramek’s words, cited in the letter, bear the signs of a calling, raises serious doubts and can be easily ruled out by analysing the content of the text with the use of the Polish Language Dictionary by the PWN [Polish Scientific Publishing House].
